Default Willowgate Fishery shut down

Apparently didn't have planning permission and unlikely to get it, probably the poor access as much as change of use. There is a note on their web site but just in case anyone has a wasted trip.

typical P & K council doing what they do best ,,,, make a mess of things.
The council is already one of the worst around and can't organise anything properly, you only need to look at Kinross to see a perfect example of what a pathetic job they do.
no encouragement for small new business's , no help around unless you do as they say and jump before they ask.

Sorry to hear of the bad news lads and lassies.
and what a great help to the unemployment figures by making the staff unemployed makes real sense. waste of space council.

Perth & Kinross Council have ordered Willowgate, a fishery and cafe, to close it's doors claiming it has not gone through due process with regards to planning permission.

Tay Salmon Fisheries, the owners of Willowgate claim their title deeds for the land fully permit them to develop it in this way and that, legally, they are not required to go through the planning process.

The council has used it's powers to force the fishery to stop trading, putting people out of work and taking away a valuable resource that is used by anglers young and old, as well as non anglers who regularly visit their fabulous cafe set up.

We want PKC to reverse their decision. They should be saving jobs and rewarding innovative businesses that bring economic benefit to Perth. Not punishing them.

On one hand PKC's Planning Department are happy to approve a massive incinerator development right at the heart of Perth which would cause untold environmental damage to the city and surrounding areas, yet on the other they close a thriving business which has a positive ecological impact and encourages the development of the Tay and its regeneration. It would be fair to say that their competency in "planning" is gravely in question and that their judgement is distinctly flawed.

Bit daft though, creating a dug out and filling it with rainbows where there is a risk of flooding into the adjacent River Tay.......

Obviously, we all hope these issues can be resolved and the fishery remain open.

In a bid to lend some clarity: title deeds (and the title conditions contained in them - permissions/restrictions/rights/obligations and so on) regulate matters between private individuals. Planning law, on the other hand, regulates matters as between individuals and the public. The title deeds may well permit development, but that has no bearing on whether planning permission is required.

Good luck for the campaign - lets hope the Council sees sense. It's particularly galling given the reported relationship between the Council and the fishery and the laudable work that's been carried out.

Whilst I have no confidence in the local council, it does seem probable that a development like a fishery/cafe would need planning permission. If that is the case, it will have to be obtained retrospectively, don't think petitions and the like will change that. Hopefully something will get sorted out.

Thanks Martin and others for your support. I will briefly outline our position so the barrack room lawyers in our midst are curtailed slightly.
The company has been served with two enforcement notices from P&K council both of which we have complied with. We are now seeking to reach a position whereas we can find out what what (if anything ) P&K are prepared to let us do.

From a personal point of view this was one of the saddest days in my life, when just under 4 years ago I came up with the idea behind willowgate worked very hard with other committed souls to deliver what is there today(incidendly we are in the final two for a civic award which it looks like we will have to pull out of).

I do sincerely hope that a compromise can be found but I am not pinning my hopes on it.

Not disputing any of that Neil but people shouldn't make the mistake of thinking that this was a naiive oversight on the part of Tay Salmon Fisheries. The owner's primary business is as a property developer and house builder on a substantial scale so he and his team are very experienced in dealing with planning matters and local authorities.
