Default Selling trout - is it legal

I always thought (and still hope) that selling trout (rainbow/brown/sea) was illegal.

Not just from a tax point of view but I was under the impression that you were allowed fish for your own and families consumption, not for financial gain.

I have seen fisherman taking all the fish left behind at competitions or deliberatley taking in excess of limits because they sell these fish to local pubs etc.

Does someone know the exact law that is being broken as we have a couple of club members that could do with being informed of the law.

Fly fishing is a sporting activity in my opinion not a business!!!!!

Unless you are on the breadline, I find selling your catch morally wrong and very much against the spirit of the sport.

You are, effectively, a fishmonger...

It is only illegal to sell rod caught salmon and sea trout in England and Wales.

Individual clubs/ fisheries might have their rules though about selling rainbows and browns as my local club does- anyone caught selling fish caught from their waters will be banned.

Environment Agency - Selling rod-caught fish could land you a hefty fine

Hi, please don't think I'm being flippant. But does it matter what law is being broken. I mean with regard to the guys in your club, can't you just tell them they're breaking club rules. A legal precedent, seems to be a bit of over kill to me. Some people just break rules, laws etc.

I hope you get where I'm coming from, just ask them to stop. Rather than quoteing something like. " according to Kramer vs Kramer the taking of fish is forbidden"

just kick em out then when folk ask why, tell them that its a gentleman's agreement that its forbidden to pass trout on for gain ,if they ask "what gentleman's agreement" just tell them that its down to the angler to find out rules and regulations just like byelaws


then put it in writing at a later date

do you know for a FACT that they are SELLING them in pubs?

When i was more into sea fishing, after our comps we would put all the fish together and distribute them to local old folks homes and such like, there was no monetary gain for us, But the old folk got some decent food. This was before we started on catch and release for comps

You also state " left behind" so i assume that the fish are dead, better someone having them to eat than just left to rot in my opinion

It is not illegal to sell trout.I suppose you should declare the income on your tax form but..well you wouldn't , would you? I used to sell fish to pay for my fishing in the 70s- many people did.But I keep very few now and those are gifts. Morality od selling fish ..hmm..usually suspect I think ? But if you pay a fortune to fish a non catch and release water then why not ?

So just what is the problem? Why on earth shouldn't someone sell his fish if that is what he wants to do? Better that than chuck them in the ditch on the way home.

Ah, I see, we've got the old "morality" thing going again. "I don't do it because I think it's immoral, and therefore no-one else must do it either". There's people around - poor demented souls that they are - who think sex is immoral. Good job THEY haven't got their way around to stopping THAT.

I enjoy fishing and catching fish. What I don't enjoy is eating them. I'll eat maybe two or three trout a year. Fortunately I can now fish a C&R water more or less all the time if that is what I wish to do. If I need a few fillets for the freezer or to give away I'll catch & kill and that is not very often. However, in the not so distant past all my fishing was catch & kill because that was the rule on the waters I fished. I would end up with dozens of fish in the freezer that wouldn't get eaten, so I took to selling them to my local pubs. They went down well with the customers, and I was able to balance the books a bit. I see absolutely nothing wrong with that at all.

The morality moaners need to get off their high horses. There's nothing to be proud about in beating some stupid stockie to death and considering yourself holier than thou, especially when most anglers of my acquaintance don't eat the things anyway.

Of course it's not illegal, as long as you declare your "income" to the tax man.

As for being a "fishmonger." If the rules state that you must take home your 6 fish limit (after June 1st), as I did at Ladybower, after three visits, what are you supposed to do with 18 fish a week, especially if someone kindly offers to take them all off your hands - for a small remuneration?
