Default Pole, Stick, Bamboo

If you fish with a pole, stick or piece of bamboo with a bit of line attached to the end, do you need a rod license?

Yes, even if your rod is one of the makes you've listed, Sage, Winston or Hardy you still need a license.

You certainly do!! Anywhere you intend fishing with a rod & line within England Or Wales, you need an EA rod licence!

think you missed the point I was trying to make or question I was trying to get answered... in that a pole etc isn't a rod.

Anyone know if there is somthing in the rules that say's a pole is classed as a rod? Or that a thin branch from a tree is also a rod? Or a piece of bamboo is a rod?

AFAIK the legislation in England and Wales is for "rod and line". Does it say anything about pole and line? tree branch and line? bamboo and line? even just line on its own?

I think you'll find that neither semantics nor ontology forms a viable legal defense.

In any case, the law is worded so that it is an offence to fish with an unlicensed instrument. This is the wording under which you commit the offence:

27 Unlicensed fishing

A person is guilty of an offence if, in any place in which fishing for fish of any description is regulated by a system of licensing, he—

(a)fishes for or takes fish of that description otherwise than by means of an instrument which he is entitled to use for that purpose by virtue of a fishing licence or otherwise than in accordance with the conditions of the licence; or

(b)has in his possession with intent to use it for that purpose an instrument other than one which he is authorised to use for that purpose by virtue of such a licence.
