Default poaching......or not

Somthing i have always wondered for some time now.

Most rivers that are club waters are run and owned by the club.

Does that only include the land?

If i was to get a float tube or small dingy and go on the water at a free stretch, then allow my self to float along with the river fishing from the middle would i be poaching if i was to float past the privatly club owned banks?

Yes you would be poaching.

It's got nothing to do with the land or access from land. It's the right to fish on those waters.

so how do i go about owning water that is not static?

You don't, and you can't. No one owns running water.

It's not access to the water that is privately owned, or leased. After all dog walkers don't need to pay to let their pets chase sticks into the water.

It is the right to fish there that is either leased or privately owned.

I don't know really PP. I thought with it being a trade member then there must be some reasonable excuse for posing the question. I'm guessing not though.

have looked into this now.

the fishing rights need to be applied for by the land owner who either owns all of the river bed or half of it. They can then sell or lease the rights to fish to clubs etc.

If i wanted to float and fish a river i guess i would have to find all the landowners along the river, on both banks, then find out the fishing rights.

What a head ache...

have been itching to have a go at a stretch of water for some time, guess it will take a bit longer now.

can you imagine going down river in a dingy equipped with gps so you know when to take your rod out of the water and when to face the left bank and the right bank.

lmao...

I don't understand why as a fisherman you don't understand the basic law of the right to fish certain waters, on rivers, and still water. Most Clubs pay a huge amount for the exclusive right to fish rivers and lakes.
You seem to want to get round this right and that is where you are then thinking like a poacher.

i dont fish rivers that much so do not have a good knowlage about the rights etc, or how they came about, i thought it was about the land either side of the river.....not under it.

stillwaters are different, you pay to catch fish in a pond that is stocked with no escape for the trout, or lake soley on private land.
