Default Why isn't all sea fishing for sea trout free?

Quick question which someone might know the answer to.
Sea trout fishing in tidal pools on North and South Uist requires a permit (I'm not talking esturies here but off the beach/wading and flyfishing for the little blitters),
Why can the estates charge you for this type of fishing? Does this mean if one was fishing say for mackerel would you still need a permit?
I'm kinda puzzled as generally sea-fishing is free just about everywhere else so if anyone knows the reason why I'd be very pleased to hear from them.

this was discussed a few days ago ,see Sea Trout section..fishing tidal water..
Regardless of myth or hearsay this is how it is regarding the law in Scotland
"1. If any person without legal right, or without written permission from a person having such right, fishes for or takes salmon in any waters including any part of the sea within one mile of mean low water springs, he shall be guilty of an offence ......"

Section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951 defines salmon as:

"Salmon" includes all migratory fish of the species Salmo salar and Salmo trutta and commonly known as salmon and sea trout respectively or any part of any such fish"
The estate or foreshore owner will have paid the Crown Estates(The Queen) a lease for the raparian rights they are basically recouping their cost.
Other species are exempt.
I always ask, if its ok to trample on someones land whilst fishing, even though there is technically no trespass law in Scotland.... I have found that it is best not to **** people off unnessesarily I always enquire about permits or get permission you would be surprised how often you are told..."och just go ahead"

Hi, thanks for that information.
I had checked the sea trout section but the thread fishing tidal waters doesn't cover this nor have any other similar threads that I have looked at.
Although I haven't managed to work my way through them all yet

Think of us s lucky (at the moment) In Canada and the US all salt & freshwater fishing requires a separate licence and I hear there are moves underway to try and introduce a similar law in the UK to licence all saltwater angling
