Default Fishing Rights - "Rods"?

Hi All,

Newbie question here so apologies if this is a stupid question.

I'm considering buying a property with fishing rights and have been told there are three "rods" with one or two of them already leased for the next 12 months.

Now maybe I'm being thick but I'm blowed if I can find an explanation anywhere of what a "rod" is and I don't want to look stupid when I view it next week!

If there's only one "rod" left for me for the next 12 months does that mean that if my brothers visit for the weekend then only one of us can legally fish at a time?

Well I might be showing my ignorance here but I've always understood the term "rod" to mean a person who has bought the right to fish a particular beat,so if the water you are interested in has three "rods" it means that three people can purchase rights in any one year

Correct,unless you can come to an agreement with the other 2 rods,when they will not be on the water. they allow you to fish their 'rods'

Just imagine the fun you are going to have when the rod leases come up for renewal when the existing rods leases expire. Do you go for 6 rods, 10 or more? Ok, you will be a little restricted possibly by the amount of rods that you can physically get on the water and the price will be reduced, but you, as proprietor, I suggest are the final arbiter in that situation.

Seriously, this an issue that the solicitor acting on your behalf of the purchase of the property should be aware of and can give you appropriate advice upon.

The definition of a rod can also vary depending on what part of the country you are in and the species of fish. Other variants will involve whether it is single or double bank and, if single, if your bank has an arrangement with the opposite bank to fish certain parts of the beat at set times.

Default Apparently I'm now a riparian owner!

Just to update my own post, I did end up buying the property/fishing-rights so can now clarify exactly what a 'rod' means in my area (mid-Wales.)

A rod is the right to fish the beat on a particular day of the week. So in my case two rods had already been leased out but on different days. So this meant that five days a week there are still three rods for me to use and on the other two days there are only two rods left for me to use.

Gunner100 raised an interesting point that the current "maximum of three rods" seems an arbitrary figure. It's a half mile stretch of the Wye I've bought and when my brother and brother-in-law came down a couple of weeks ago, to give me my first fly fishing lesson, all three of us were comfortably fishing in probably less than 200 yards; out of curiousity how many 'rods' would people expect to be able to fish in half a mile of (mostly) double bank fishing?

As suggested in my initial post, hopefully your solicitor will have established the legal position when he acted on your behalf in purchasing the land. If you own the fishing rights as opposed to leasing them, then it will be up to yourself to decide the number of rods to be allowed at any one time. If the rights are only leased it is the lessee who has the final say.
