Default Lawyer ordered to tear down riverside garden decking as judge backs anglers' ancient rights to fly-fish for salmon

A lawyer has been ordered to pull down the £3,000 decking from the bottom of his riverside garden, after a judge ruled it breached anglers’ ancient rights to catch salmon by any and all lawful means.

Branislav Sudjic had been in a long-running legal battle with anglers who claimed the decking prevents them from fly-fishing.

He installed the decking eight years ago in his garden overlooking the River Tummel near Pitlochry, Perthshire.

And if the landowner had been an old granny? Would the Mail still be lending to the "right up ya" sentiment? It's a pity everybody seems to assume the landowner was some nasty and unpleasant person. It was obviously not a clear point of law. Hardly a case of the landowner deliberately and maliciously trying to ride roughshod over the the rights of anglers. Glad it's going though. It's butt ugly.

£3000 for that? It looks like Sh1t. Completely incongruous with the rest of the surroundings.

"Mr Sudjic, who practices in Kirkcaldy, argued that anglers could still take salmon by spinning with lures - small spinning blades that mimic small fish - and that was all the law entitled them to do".

Sounds like a bit of an arrogant James Hunt too.

Branislav Sudjic versus Sheriff Principal Alastair Dunlop, who reversed the earlier decision in April last year.

No contest really, kind of restores one's faith in Scottish justice, after all even Spey casting would have been tricky.

How it looks isn't the issue really. I personally think this is really petty to be honest.

Noticed this in the comments below the article....

"Good, it's a hideous structure, totally out of keeping with the landscape and riverside habitat. What if every land owner decide to build a similar platform on their property. It would have been a dangerous president to set."

Correct, my thoughts exactly. The guy was right in saying that in high water they will only be spinning from that bank anyway. There's trees directly in line with the decking structure, why don't they cut down the trees and free up a bit more casting room, if they really need it that is?

My take is the anglers just decided to get uppity and once again flexed their muscles whilst cocking their legs and pissing on the decking to hammer home the point that it's 'our' river, not yours.

We've bought out the nets, stopped old men catching minnow in a bottle with their young grandsons , thrown boulders at canoeists, and now stopped a local landowner from enjoying the river with friends on a warm summer evening whilst supping a vintage bubbly.

What a missed opportunity for anglers to have someone directing their flies over an (clearly visible from the high vantage point) salmon lying in the stream.

What a missed opportunity to promote their fishery with unusual photographs and video footage, shot from the high vantage point. Would have made some darn nice viewing.

Just my tuppenceworth though.

A three thousand pound loss is inconsequential, mere peanuts to a lawyer, easy come easy go! The rather thrusting status symbol was probably only to impress his "friends" anyway. Good to see a rare stuffing from some one in the same business!
